The Arizona Supreme Court will be making a decision today on setting an execution date on death-row prisoner Daniel Wayne Cook. Cook is in jail for killing two people in 1987. "Among the factors that could weigh into the court's decision is an indication from the U.S. Food and Drug Administration that it will exercise "enforcement discretion" and allow the importation of sodium thiopental for prisoner executions. The drug, one of three used in Arizona and most other states that perform lethal injections, has been in short supply in the U.S.
An FDA spokeswoman told The Arizona Republic last week that the agency would "continue to defer to law enforcement on all matters involving lethal injection," suggesting that the agency will allow states to continue to import the drug from abroad.
That potentially removes an obstacle for states attempting to obtain the drug for pending executions."

Phoenix court officials ruled that DMX is headed to jail for a year after breaking his parole. Earlier this month his probation was revoked after some issues with his drug treatment program. He was kicked out of the program after having a drink on stage at a club in Scottsdale Arizona. Adding the list of problems DMX refused a drug test and was driving with a suspended license. DMX has had some earlier run-ins with the law that included hitting a jail guard and falsifying a name to get out of hospital bills.
